I'm very glad you submitted this to BADD. Loopholes are being used against pwd in court and on the job. Employment numbers are a disgrace. People are still without sufficient (and in some cases any) protection getting jobs ,keeping jobs and regarding job conditions - loopholes, loopholes, loopholes. Thanks for this post.

Disablism is an organized and conscious affair. It differs from ableism which is simply a fear and misunderstanding about disability. The person who wants to pray for me on the public bus is an ableist.

I like this distinction. Are you the inventor? Because I'm going to start using it to be specific about events and people acting against us.

Pretext exists where the ostensible reason for the employment decision is really a lie contrived to mask unlawful discrimination. . . . This circuit adheres to the honest- belief rule: even if the business decision was ill- considered or unreasonable, provided that the decisionmaker honestly believed the nondiscriminatory reason he gave for the action, pretext does not exist. . . .
